Seatrade 2010 Apple iPAD Contest Terms and Conditions

Eligibility: The promotion (“Seatrade Raffle”) is open to all legal residents of the fifty (50) United States and the District of Columbia 18 years or older at time of entry, who is an attendant of a 2010 Seatrade Tradeshow. NO PURCHASE NECESSARY. Employees officers, directors, shareholders of Agilysys, and their affiliates, subsidiaries, parent companies, representatives, and agents, (collectively, “Released Parties”), and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households, whether related or not, of the above, are not eligible. Void where prohibited or restricted by law. The promotion is subject to all applicable federal, state, and local laws and regulations.
To Enter: The promotion starts at 12:00:01AM Eastern Time (“ET”) on March 16, 2010 and ends at 11:59:59 PM ET on March 18, 2010 (“Promotional Period”). How to enter: submit your entry by March 18, 2010 to Agilysys Seatrade Booth. All eligible entries will be entered into a drawing to win an Apple iPAD. No entries will be acknowledged or returned, and all entries become the property of Agilysys. Agilysys is not responsible for lost, late, illegible, incomplete or misdirected entries. Such entries will be disqualified.
Promotion Drawing and Notification: Drawing and Notification: The potential winners will be selected on or about March 18, 2010 in a random drawing from among all eligible entries received under the direction of Agilysys whose decisions are final in all matters relating to the Promotion. The potential winners will be contacted by Agilysys on or about March 18, 2010. If the prize is returned undeliverable, then the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate potential winner. In the event of non-compliance with these Official Rules, or if the prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate potential winner by March 25, 2010 by selecting another entry from the drawing. If the prize is won by an eligible individual who is not of the legal age of majority in the state of residence (“minor”), the required documents must be confirmed and signed by winner’s parent or legal guardian. By participating, a winner, except where prohibited by law, grants Sponsors and their affiliated companies the right to use the winner's name, likeness, picture, biographical information and written or oral statements, for advertising and promotional purposes without additional compensation unless required by law.
Promotion Estimated Odds: The actual odds of winning will depend upon the total number of eligible entries received during the Promotional Period.
Prize: One (1) Apple iPAD. The Approximate Retail Value (“ARV”) is $499.00.
Limitation of Liability: By participating in the Promotion, entrants agree to release, indemnify and hold harmless Released Parties from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting, in whole or in part, directly or indirectly, from or arising in connection with the participation in the Promotion or acceptance, possession, use, misuse, or nonuse of the prize that may be awarded. Released Parties are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing of entries or in any Promotion related material, the announcement of the prize; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, text messages, delayed or illegible entries; or for electronic, computer, or telephonic malfunction or error, entries which fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly, or are lost for any reason including computer, telephone, or paper transfer or human or other error. Sponsor reserve the right to modify prize award procedures. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the promotion may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserve the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
Termination of Promotion: If in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise, corrupt, or affect the administration, integrity, security, fairness, or proper conduct of the Promotion, the Sponsor in its sole discretion reserves the right to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently, to modify or suspend the Promotion, or to terminate the Promotion and conduct a random drawing and award the prizes using all eligible non-suspect entries received as of the termination date.
Applicable Law: All entrants agree that the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsor in connection with this Promotion shall be interpreted in accordance with the laws of the State of Ohio; and that any dispute shall be resolved in either federal or state courts located in the state of Ohio without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the State of Ohio.
